Legislação e normativas do Poder Judiciário sobre arquivos e memória da Justiça do Trabalho: estudo a partir do Tribunal Regional do Trabalho da 1ª Região

Abstract

O objetivo dessa dissertação é identificar nas normativas e iniciativas do TRT/1ª Região, referendadas pelo corpus normativo do Poder Judiciário, as disposições relacionadas aos arquivos e à memória, expondo, em contrapartida, o que silenciam sobre esses temas de forma a comprometer o acesso à informação e a preservação da memória institucional e do trabalho. A utilização do método qualitativo envolveu a pesquisa bibliográfica e documental, possibilitando analisar o universo dos arquivos judiciais trabalhistas. A reflexão sobre esses arquivos e sobre a legislação que lhe dá suporte possibilitou o debate acerca das políticas arquivísticas no Brasil, especialmente no Poder Judiciário, demonstrando seus entraves e possibilidades. A atuação do TRT/1ª Região ao longo dos anos revela o descaso inicial com seus documentos de arquivo e uma posterior tentativa de reverter esse quadro, visando atender às determinações legais e buscar legitimação perante a sociedade. O produto, fruto da pesquisa, consiste no mapeamento das ações da memória dessa instituição e na proposta de uma ação educativa visando contribuir para a divulgação do acervo documental do TRT/1ª Região e para a memória do trabalho e da Justiça do Trabalho.

The objective of this dissertation is to identify in the regulations and initiatives of the TRT/1st Region, endorsed by the normative corpus of the Judiciary, the provisions related to archives and memory, exposing, on the other hand, what is silent on these topics in a way that compromises access information and the preservation of institutional and work memory. The use of the qualitative method involved bibliographic and documentary research, making it possible to analyze the universe of labor court files. Reflection on these arc legislation that supports them enabled the debate about archival policies in Brazil, especially in the Judiciary, demonstrating their obstacles and possibilities. The performance of the TRT/1st Region over the years reveals the initial disregard for its archival documents and a subsequent attempt to reverse this situation, aiming to comply with legal determinations and seek legitimization before society. The product, the result of the research, consists of mapping the actions of the memory of this institution and the proposal of an educational action aimed at contributing to the dissemination of the documentary collection on the TRT/1st Region and the memory of work and the Labor Court.
